when cease and desist letters are sent out and actors are deprecated, what happens if another developer creates the same actor?

That’s a great question I’d also like to know Apify’s stance: if they receive a cease and desist order, do they immediately take down your scraper, or do they first verify whether the data is publicly available? Do they only remove it if a court orders them to, and to what extent does Apify protect the developer against a standard cease and desist from the site owner?

It is very individual. There were cases where we did put some Actor down but that's super rare. Usually, it is just about changing some trademarked logo etc. Our legal department goes through each case individually and fights back, removing Actor is only the last resort. Ofc if you do something clearly harmful, we will view it differently.

It is not that common overall.
